There should be a “reasonable possibility” that drugs or alcohol could have caused or contributed to the accident before post-accident testing is done.
Testing should not be conducted in circumstances where drugs and alcohol COULD NOT HAVE been a factor, for example, insect stings, animal bites, allergic reactions, repetitive stress injuries, injuries resulting from pre-existing illnesses (such as diabetes, epilepsy, etc), slips and falls on ice, among other things.
Nitro’s Policy reads as such: Conduct a post-accident drug or alcohol test of any employee who may have caused or contributed to an accident. The drug or alcohol test shall be conducted as soon as possible after the incident occurred and after any necessary medical attention has been administered to the employee.
