1.0 PURPOSE
The Spill Prevention, Control, and Countermeasure (SPCC) rule include requirements for oil spill prevention, preparedness, and response to prevent oil discharges to navigable waters and adjoining shorelines. The purpose of this procedure is to prevent oil from entering navigable waters through the prevention, control, and mitigation of oil spills.
2.0 RESPONSIBILITY
The Project Manager shall ensure the full and effective implementation of this procedure. All employees shall follow the requirements sets forth in this procedure.

4.0 DEFINITIONS
4.1 Bulk Storage Container – a container used to store oil that has a capacity equal to or greater than 55 gallons.
4.2 Clean-up Operation – an operation where hazardous substances are removed, contained, incinerated, neutralized, stabilized, cleared-up, or in any other manner processed or handled with the ultimate goal of making the site safer for people or the environment.
4.3 Discharge – includes, but is not limited to, any spilling, leaking, pumping, pouring, emitting, emptying, or dumping of oil (excludes permitted discharges).
4.4 Facility – a structure, or area in which oil is stored or that is administered by the same owner or operator.
4.5 Mobile refuelers are bulk storage containers onboard a vehicle or towed, that are designed or used solely to store and transport fuel for transfer into or from an aircraft, motor vehicle, locomotive, vessel, ground service equipment, or other oil storage container.
4.6 Navigable Waters – include all waters that are used in interstate or foreign commerce, all interstate waters including wetlands, and all intrastate waters, such as lakes, rivers, streams, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, or natural ponds.
4.7 Oil – includes a variety of substances that are petroleum and non-petroleum based. Examples of oils and oil-containing products include, but are not limited to:
4.7.1 Petroleum-based: Gasoline, Diesel fuel, Motor oil, Heating fuel, Jet fuel, Aviation fuel, Hydraulic fluid
4.7.2 Non-Petroleum-based: Animal-based oil, Vegetable oil, Biofuel
4.7.3 Oil-containing Products: Oil-based paint, Oil-based thinner, Oil-based ink, Petroleum-based parts washer solvent, Roofing tar
4.8 Spill Prevention, Control, and Countermeasure (SPCC) Plan – refers to the written set of procedures required under 40 CFR 112.3. Procedures must detail in writing, the equipment, workforce, and steps required to prevent, control, and mitigate a discharge of oil.
5.0 PROCEDURE
5.1 The SPCC rule includes spill prevention and countermeasure plans for spills from aboveground and certain underground storage tanks. A construction site project must meet SPCC regulatory requirements if it meets the following three criteria:
5.9.1 It stores, uses, transfers, or otherwise handles oil;
5.9.2 It has a maximum aboveground storage capacity greater than 1,320 gallons of oil (which includes both bulk and operational storage volumes) OR total underground storage capacity greater than 42,000 gallons of oil; AND
5.9.3 There is a reasonable expectation (based on the location of your site) that an oil spill would reach navigable waters or adjoining shorelines of the U.S.
5.2 Preparation of the SPCC Plan is the responsibility of the facility owner or operator or it can be prepared by an engineer or consultant but it must be certified by a registered Professional Engineer (PE).
5.3 To minimize the potential for a spill, chemicals must be stored in appropriate containers and in specified areas when not in use.
5.4 Good housekeeping must be maintained while on-site as this is the best management practice to prevent spills.
5.5 Spill kits or spill response materials (i.e., absorbent pads) must be kept on-site as required by the facility and adequate for any anticipated spills.
5.6 If a spill occurs, the spill response procedures outlined below must be followed.
5.6.1 Identify the spilled material;
5.6.2 Restrict the flow of any remaining material within the original container;
5.6.3 Confine the spill area with absorbent materials or dikes;
5.6.4 Begin remediation and decontamination of the affected areas;
5.6.5 Notify all appropriate parties (Facility owner, Nitro Construction Services Project Manager, Corporate Safety Director)
5.3.5.1 The EPA must be notified of any spills over 1,000 gallons or of any two spills over 42 gallons within 12 months. This is the responsibility of the facility owner.
5.7 All employees will be trained on proper spill prevention and response procedures as required by each facility. Training shall be documented.
6.0 RECORDKEEPING
6.1 The spill details must be documented, including but not limited to the identity of the material, the amount released, corrective actions are taken, cause of release, additional preventive measures taken, etc.
6.2 The copy of the report with oil spill details should be attached to the SPCC plan for any reportable oil spills.
