General Revision; reformat and renumber procedure

1.0 PURPOSE
The purpose of this procedure is to establish written requirements for subcontractors of Nitro Construction Services.

2.0 RESPONSIBILITY
The Subcontractor’s site manager/superintendent for the project shall be responsible for the implementation of the requirements outlined in this procedure.

3.0 DEFINITION
3.1 Subcontractors – A person or entity who has a contract either directly or indirectly with Nitro Construction Services to perform any portion of the work at a job site or to provide services, equipment, or materials to Nitro Construction Services for use in the performance of the work.

4.0 QUALIFICATIONS
Subcontractors must meet the following pre-qualification requirements to perform work for Nitro Construction Services. Sub-Contractor Qualification Questionnaire (NCS Form 036) must be completed and submitted to Nitro Construction Services before being considered for subcontractor status. The following are minimum requirements:
4.1 Subcontractors must not have an EMR of greater than 1.0 for the most recent year.
4.2 A recordable incident rate of less than 4.0 averaged over the last three calendar years or meet client-specific requirements.
4.3 Written Environmental Safety and Health Program.
4.4 Written Substance Abuse policy.
4.5 Insurance: Workers Compensation, Liability, Comprehensive General Liability, Comprehensive Automobile Liability, and Excess liability insurance.

5.0 COMPLIANCE
Subcontractors shall comply with all OSHA, Nitro Construction Services, and client Environmental, Safety, and Health procedures.
5.1 Subcontractor shall comply with all objectives and requirements of the project.
5.2 Subcontractor shall name the Designated Safety Representative for the project on the Subcontractor Questionnaire form. The Designated Safety Representative shall meet the requirements of a Competent Person as defined by 29 CFR 1926, and have the authority to administer the Subcontractors safety program including the implementation of prompt corrective actions.
5.3 When the Subcontractor workforce exceeds 25 or more workers, the subcontractor shall employ a full-time Safety Coordinator on site, approved by Nitro Construction Services, as a competent person to perform safety responsibilities for the scope of work to be performed.
5.4 All on-site subcontractor employees must complete Nitro Construction Services and Site-Specific orientation before performing work on site.
5.5 All on-site subcontractor employees must provide proof of a non-positive drug test before performing work on site. The test must have been within one year to date or meet site requirements, whichever is more stringent.
5.6 Subcontractor employees on-site will be subject to pre-employment, post-accident, random, and for-cause drug and/or alcohol testing. The subcontractor will adhere to the Nitro Construction Services EH&S policy for all employees on site.
5.7 Subcontractors will be required to conduct or attend a weekly safety meeting. Copies of the meeting minutes and signatures of attendees must be forwarded to Nitro Construction Services Supervision or Safety Representative on the same day.
5.8 Subcontractors will be required to use the Nitro Construction Services Job Safety Analysis (JSA), or project required equivalent, for each task. These are to be completed for each job (at least daily) and returned to Nitro Construction Services Supervision or Safety Representative.
5.9 Subcontractor will be required to report the number of their employees on-site to Nitro Construction Services Supervision within one half (1/2) hour of the start of each shift.
5.10 Subcontractors will be included on all Nitro Construction Services safety audits, to ensure compliance with Nitro Construction Services and Site-Specific procedures. Subcontractors will have twenty-four (24) hours to correct minor issues. If a subcontractor has an Immediately Dangerous to Life and Health (IDLH) or serious situation, the issue must be corrected immediately.
5.11 Subcontractors shall assure that all work-related injuries and illnesses requiring a physician’s care are reported to Nitro Construction Services Supervision or Safety Representative immediately. Copies of incident reports shall be provided within 24 hours to Nitro Construction Services Supervision or Safety Representative.
5.12 Subcontractors shall thoroughly investigate all incidents and near misses and shall provide written documentation of its findings to Nitro Construction Services Supervision or Safety Representative promptly.
5.13 Subcontractors will be subject to contract termination for safety violations.
5.14 Subcontractors are responsible for the inspection (documented daily), and maintenance of equipment, used by sub-contractor.
5.15 Upon completion of a project, or phase of the project, each subcontractor shall be comprehensively evaluated using the Performance Evaluation sheet NCS Form 36.2. The Evaluation shall include the safety performance of the subcontractor throughout the project. This Evaluation will be utilized in determining the renewal of contracts for the subcontractor on future projects.
